1. Information We Collect

• Account information: email address (via passwordless magic link authentication)
• Content: company logos you upload for processing
• Technical data: IP address, browser type, device information
• Free preview data: if you use the free preview, we store your email address and a usage counter to enforce the preview limit. This also lets us contact you about the product where you have consented
• Payment information: processed by Stripe — we do not store credit card data on our servers

2. How We Use Your Information

• Generate custom branded backgrounds using your logo
• Process payments and deliver your orders
• Communicate order status via email
• Prevent abuse and enforce rate limits
• Send product updates and promotional offers (with your consent)
• Send review invitation emails after purchase completion

3. Third-Party Services

We use the following categories of third-party services to operate HeyBackdrop:

• Payment processing and tax handling (Stripe, Inc.) — acts as merchant of record for your purchase
• Database and authentication (Supabase Inc.)
• Cloud storage and CDN (Cloudflare, Inc.)
• Email delivery (Resend, Inc.)
• AI image generation (Google LLC — Gemini and Imagen)

• Review collection and display (Trustpilot A/S)
• Security and bot protection (Cloudflare Turnstile, hCaptcha)

4. Cookies & Tracking

• Essential cookies: authentication session cookies required for the service to function
• Security cookies: hCaptcha and Cloudflare Turnstile tokens for bot protection
• Analytics cookies: Microsoft Clarity for behavioral analytics — only loaded after user consent
• Marketing cookies: Trustpilot Review Collector widget — only loaded after Marketing consent via Zaraz
• We do not use advertising cookies for ad targeting

Cookie consent is managed via Cloudflare Zaraz. Non-essential cookies (analytics) are only loaded after you provide consent. You can manage your preferences at any time through the cookie settings on the website.

5. Data Retention

We keep data only as long as it serves the purpose it was collected for:

• Account and order records: for as long as your account is active, and afterwards for the period required by accounting and tax law
• Uploaded logos and generated backgrounds: kept so you can re-download your purchases; deleted on request
• Free preview data (email and usage counters): kept to enforce the preview limit; deleted on request
• Marketing subscriptions: until you unsubscribe

You may request deletion of your data at any time by contacting [email protected].

6. Your Rights (GDPR)

If you are located in the European Economic Area (EEA), you have the following rights regarding your personal data:

• Right to access your data
• Right to rectification of inaccurate data
• Right to erasure (“right to be forgotten”)
• Right to data portability
• Right to object to processing
• Right to restrict processing

7. International Data Transfers

Capibara Devs LLC is established in the United States, and several of our service providers process data outside the European Economic Area. If you are in the EEA or the UK, your personal data is therefore transferred internationally.

Those transfers rely on the European Commission's Standard Contractual Clauses (and the UK Addendum where applicable), which we enter into with our processors, together with technical measures such as encryption in transit and at rest. You can request information about the safeguards applied to a specific transfer by contacting [email protected].

8. Children's Privacy

HeyBackdrop is intended for business use and not for children. We do not knowingly collect personal information from anyone under 16, or under the minimum age set by the law of their country (13 in the United States, and between 13 and 16 across EU member states). If you believe a child has provided us with personal data, please contact us so we can delete it.

9. Email Communications

With your consent, we may send you promotional emails about new products, features, and exclusive offers. You can opt in during checkout or through our newsletter signup.

• Marketing emails are only sent with your explicit consent
• You can unsubscribe at any time using the link in any marketing email
• Transactional emails (order confirmations, delivery notifications) are sent regardless of consent as they are necessary for the service
• We use Resend as our email delivery provider
• Review invitation emails are sent 24 hours after order completion to gather feedback — you can unsubscribe using the link in the email

1. Acceptance of Terms

By accessing or using HeyBackdrop, you agree to be bound by these Terms of Service. If you do not agree, you may not use the service.

2. Service Description

HeyBackdrop provides AI-powered generation of professional video call backgrounds with integrated company branding. All products are digital and delivered electronically.

3. User Responsibilities

• You warrant that you have the rights to all logos and content you upload
• You will not upload offensive, illegal, or infringing content
• You are responsible for maintaining the security of your account
• You will not attempt to abuse, reverse-engineer, or circumvent the service

4. Intellectual Property

• Your content: you retain full ownership of the logos and materials you upload
• Generated output: you own the generated backgrounds created from your order
• Showcase rights: we will only use generated outputs that contain your logo or trademarks in our portfolio or marketing with your prior consent. If you have given it, you can withdraw it at any time by emailing [email protected], and we will stop using the material in new materials
• Our platform: HeyBackdrop branding, user interface, and underlying technology remain the property of Capibara Devs LLC

5. AI-Generated Content

Results are generated by AI and may vary between generations. We do not guarantee specific outcomes or “perfect” results. Each generation produces a unique output.

6. Payment

• All prices are listed in USD
• Prices shown exclude tax. Depending on where you are, VAT, GST or sales tax may be added at checkout. The final amount, including any tax, is always shown before you confirm payment
• Payments are processed by Stripe, Inc., which acts as merchant of record for your purchase and is responsible for calculating, collecting and remitting the applicable tax
• You agree to pay all applicable charges for products you purchase

7. Limitation of Liability

The service is provided “as is” without warranties of any kind. Capibara Devs LLC is not liable for any indirect, incidental, special, or consequential damages. Our maximum liability is limited to the amount you paid for the specific order in question.

8. Termination

We reserve the right to suspend or terminate accounts that violate these terms. You may request account deletion at any time by contacting [email protected].

9. Governing Law

These terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict of law provisions. Any disputes shall be resolved through good-faith negotiation first. If negotiation fails, disputes will be resolved through binding arbitration seated in the State of Wyoming, United States.

If you are a consumer in the European Economic Area or the United Kingdom, nothing in this section removes the protection of the mandatory consumer law of your country of residence, nor your right to bring proceedings before the courts of that country. The arbitration clause above does not apply to you where your local law does not permit it.

1. Digital Product — Delivery Begins Immediately

Our products are digital and generation starts as soon as your payment is confirmed. Once a background has been generated and made available to you, the purchase is considered performed and we do not issue refunds, except in the cases described below.

Before paying, you are asked to confirm that you want generation to start immediately. Section 2 explains what that means if you are a consumer in the EEA or the UK.

2. Right of Withdrawal (EEA and UK consumers)

If you are a consumer resident in the European Economic Area or the United Kingdom, you normally have 14 days to withdraw from a distance purchase without giving a reason.

For digital content delivered without a physical medium, that right ends once performance has begun, provided you gave your prior express consent to begin and acknowledged that you thereby lose the right of withdrawal. We ask for both at checkout, in a separate confirmation, before any payment is taken.

• If you gave that consent and your background has been generated, the right of withdrawal no longer applies
• If you paid but generation has not yet started, you keep the full 14-day right and we will refund you in full
• To withdraw, email [email protected] with your order details. No particular form is required

This section does not affect your statutory rights where the goods are faulty or not as described.

3. Exception: Technical Failure

If we fail to deliver your product due to a technical error on our end, you may request a full refund. Contact [email protected] within 30 days of your purchase.

5. Not Eligible for Refund

• Dissatisfaction with AI-generated results (subjective quality)
• Change of mind after purchase
• Inability to download delivered files (we provide re-download access)

1. What Are Beta Features

Certain features on HeyBackdrop are labeled as “Beta.” These features are made available for early access and may not perform at the same level as our generally available services. Beta features may be modified, suspended, or discontinued at any time without notice.

2. No Warranty

Beta features are provided “as is” and “as available” without warranties of any kind, including but not limited to availability, accuracy, or fitness for a particular purpose. Capibara Devs LLC makes no guarantees regarding the performance or reliability of Beta features.

3. Not Subject to Refunds

Beta features are included as a bonus with your purchase at no additional cost. Because no separate charge is made for them, there is nothing to refund in respect of a Beta feature on its own, and the Refund Policy applies to the core product you purchased. This does not limit your statutory rights if the core product itself is faulty or not as described.

4. Fair Use Policy

Beta features are subject to fair use limits to ensure quality for all users. These limits are set per user and may be adjusted at our discretion. Attempting to circumvent fair use limits may result in restricted access to Beta features.

5. Changes and Discontinuation

Capibara Devs LLC reserves the right to modify, limit, or discontinue any Beta feature at any time, with or without notice. We may also transition Beta features to generally available status, which may include changes to terms, pricing, or functionality.
